Even before Nick Diaz could issue a strike, he is being dealt a big blow.

The comeback of both Anderson Silva and Nick Diaz to the Octagon in January 2015 is in danger of not pushing through following reports that Diaz was arrested on driving under the influence (DUI) over the weekend. What makes the incident much worse is the revelation that this is not his first offense and that he has missed a lot of court dates.

The black sheep of mixed martial arts was arrested Dec. 12 of last year and was charged with his first DUI. He was supposed to plead his case before the court but missed several opportunities before agreeing to surrender on Aug. 21 and pay a hefty penalty of 25,000 for his temporary release. However, just ten days later he was arrested again on the same charges and with a suspended license.

The UFC has already stated its official stand on the issue and is still mum if the fight will push through.

"We are aware of the situation and are in the process of gathering the facts. We understand that there is a legal process that will now take place and that Nick Diaz will have the opportunity to address the situation in the near future," the league stated via MMA tv.

Fans of both Silva and Diaz will have to play a wait and see approach given the legal complications of Diaz's situation. It is unclear if his bail will be revoked given the propensity and multiple violations of the same offense or if any court date will coincide with the fight or the date leading up to it. Diaz can realistically go for a plea bargain just to keep him out of jail given the financial ramifications that are on the line for UFC 183.

The Mexican has had a history with trouble as he was involved in controversy after controversy. He tested positive twice for marijuana use after his bouts with Takanori Gomi and Carlos Condit in UFC 143. He was also pulled from his first fight with Georges St. Pierre for not showing up for the pre-fight press conference. Now, he is in danger to lose his dream clash with "The Spider" as his extra-curricular activities are again getting in the way. What has become the talk of the MMA community in July may just go up in smokes after all.
