In Sept 10, 2013, Apple introduced an all new and redesigned iOS 7.

"iOS 7 is completely redesigned with an entirely new user interface and over 200 new features, so it's like getting a brand new device, but one that will still be instantly familiar to our users. Next month we'll be shipping our 700 millionth iOS device, and we're excited about what our hundreds of thousands of iOS developers are doing to bring great new features to their apps," as announced by Craig Federighi, Apple's senior vice president of Software Engineering.

According to Mixpanel, there were already 93 per cent of Apple devices updated to the iOS 7 on the very same day that iOS 7 was released.

However, on Oct 17, 2013, Mark Menacher, a man from California, lodged a complaint against Apple over "unwanted" downloads of iOS 7 onto his family gadgets, CNET reported.

The case was specifically filed against Cook in the Superior Court of California in San Diego. The case was particularly asking for Apple to remove the iOS 7 install file which is automatically downloaded to devices connected to power and Wi-Fi connection. Although the file will not install iOS 7 on a device without the users' approval, a prompt to install is showing anytime and every time users restart their devices.

"Apple's disregard for customer preferences in relation to iOS7 is corporate thuggery. Steve Jobs was reportedly rough on company employees in pursuit of happy customers, but Tim Cook apparently cultivates a culture of contempt for customer satisfaction in pursuit of corporate profits. It is a policy that will eventually fail," the statement of Mr Menacher stated.

Mr Menacher's complaint, following another complaint filed with the better Business Bureau in September, called for Apple to create a means for users to do away with the download installer file.

Mr Menacher told CNET that he is contemplating to raise the case to a higher court and also he is looking if he can file a class action case against Apple.

In September, those users who chose not to upgrade to iOS 7 were frustrated to discover that their iOS devices had already downloaded and upgraded to the iOS 7 update, and worse, it can no longer be downgraded to iOS 6 even within iTunes or through the device itself.
