The legal team representing the woman behind a multimillion-dollar sexual harassment claim against Australian department store David Jones (ASX: DJS) are tipped to file an amended statement of claim this afternoon.

Federal Court Judge Geoffrey Flick last week gave the lawyers of David Jones publicist Kristy Fraser-Kirk until today to revise the claim against the company in order to include in it more women who have allegedly since come forward to back Ms Fraser-Kirk's case.

While the number of women asserting to have been harassed by DJ's former chief executive Mark McInnes has grown to double-digits, Ms Fraser-Kirk remains the only one suing the department store.

Ms Fraser-Kirk is seeking punitive damages for sexual harassment, asking for 5 per cent of the $700 million in profits David Jones made between 2003 and 2010 when Mark McInnes was chief executive and another $2 million from Mr McInnes, 5 per cent of his salary.

She claimed to be one of 16 women to have been harassed either while working at David Jones or for its former chief Mark McInnes, and in most cases both. She said the $37 million, which represents 5 per cent of the department store's profits during McInnes' leadership, will be donated to a charity.

From today, David Jones and Mr McInnes have two weeks to file their defences.
