ICAC report identifies erring former NSW housing official, recommends filing of criminal charges
An independent corruption watchdog report said Wednesday that an ex-officer of the NSW Housing Department should be indicted following its findings that he failed to disclose conflict of interests in work contracts that are worth millions of dollars.
Frank Garzaniti was acting team leader of the Macquarie Fields office in 2001 when Greenfield Development, run by Frank Santomingo and business partner of Mr Garzaniti, won a contract for lawn and maintenance work.
The Independent Commission Against Corruption (ICAC) said that the same contract with NSW housing had obtained annual contract renewal until 2007 despite the absence of any competitive screening.
ICAC noted that Mr Garzaniti was tasked to process and verify the work of Greenfield, which was part of his responsibilities, and for the next seven years he approved payments and recommended contract renewals to a company that he was a part of without any declaration of conflict of interests.
ICAC added that on top of the $2.7 million contracts they had secured, Mr Garzaniti and Mr Santomingo also obtained a $2.6 million contract of demolition and tree lopping work via the G&F Plant Hire, a company where the two were joint directors.
ICAC said that Mr Garzaniti deliberately failed to inform the NSW Housing authorities about his position on the contracting company and "he continued to benefit financially from that work form which he derived substantial personal financial benefits."
The commission has recommended that the Director of Public Prosecutions file possible criminal charges against Mr Garzaniti for misconduct in public office as "he engaged in corrupt conduct by failing to declare conflicts of interest involving contracts worth up to $5.3 million for Housing NSW work."
ICAC, however, said that no sufficient evidence had surfaced to include Mr Santomingo on the criminal charges as it added that the NSW Housing Department has since implemented reforms to effectively manage corruption incidence and Mr Garzaniti has resigned from the department in 2008.
