Katie Holmes is bound by the non-disclosure clause in her divorce settlement from Tom Cruise, but she’s still “happy” to give evidence about her defunct marriage to the A-lister if necessary. A report claims that the former “Dawson’s Creek” actress might be called to testify on her ex-husband’s $50 million defamation case against Bauer Media.

The 34-year-old actress ended her six-year marriage to Cruise in 2012. The details of their divorce agreement are unknown, but it is believed that she signed a non-disclosure agreement that prohibits her from revealing anything about their marriage.

But that might change if she is called to testify on Cruise’s case against the tabloid publisher. Bauer Media has published two articles in 2012, claiming that he has abandoned his and Holmes’ daughter Suri Cruise after their divorce in July.

If the case goes to trial, there’s a possibility that Holmes would be called to testify, which means that she would have to tell the court about her marriage to Cruise.

And apparently, she would be “happy” to do so.

According to MailOnline, a deposition might be Holmes’ only chance to speak openly about her marriage, and which she wouldn’t want to pass up.

“Katie has been dignified, she has got her life back together following her divorce from Tom and is devoted to Suri, who’s the only person who matters to her,” a source told the UK paper.

“But if this case comes to court, Katie could be deposed and this means she would have to reveal details about her marriage – but to be honest, this is her chance to speak openly and she’ll be happy to do it.”

A court deposition in September has revealed that one of the reasons Holmes divorced Cruise was to protect Suri, who is now seven years old, from the Church of Scientology, which Cruise is famously a member of.

Transcripts of the exchange between the actor and Bauer’s lawyers were published by RadarOnline.com earlier in November.

When a lawyer from the other party asked if Holmes divorced him “in part to protect Suri from Scientology,” the Hollywood star lashed out, saying the question was offensive.

But Bauer’s legal team insisted for an answer, saying, “And Ms Holmes has never indicated in any way that was one of the reasons she left you? ...To protect Suri from Scientology?”

Cruise conceded, saying, “Did she say that? That was one of the assertions, yes.”

Bert Fields, Cruise’s attorney, told E! News that he believes the case will go to trial and that Bauer would subsequently be forced to pay the actor “enormous damage.”
