NZ Court That OK’d Naked Jogging by Tauranga Man Disallows Him to Garden in the Nude (VIDEOS & PHOTOS)
Running without clothes in a secluded area is OK, but gardening in the nude is not, a New Zealand court told naturist Andrew Pointon.
Mr Pointon was initially found guilty in August 2011 of offensive behaviour by the Tauranga District Court for jogging in the buff through McLaren Falls. However, when he appealed the court decision to Justice Paul Heath of the High Court in Tauranga, the judge favoured him.
But Mr Pointon was again arrested and charged of indecent behaviour for gardening and mowing his lawn on Jan 5 and March 30, 2012 nude. He pleaded not guilty to the charges before the Tauranga District Court in May and was fined $300 and $350.
Mr Pointe again appealed the fine to the High Court on Friday, but the decision released on Tuesday by the same justice, Mr Heath, was not in his favour.
The naturist claimed as the basis for his appeal that he was not given proper legal representation, but the justice insisted Mr Pointon received a fair hearing.
In dismissing the petition, Mr Heath pointed out that Mr Pointon knew by mowing his lawn and gardening naked, his neighbours would be offended, but the situation is different in his nude runs because children, especially, won't be around to see his private parts.
Besides acting like he was Adam when he was still in the Garden of Eden, Mr Pointon also joined naked bike rides held on March 9 at the Omanu Beach and Papamoo Beach.
