Pastor Refuses to Marry Couple with Intellectual and Physical Disabilities; 6 Insane Marriage Laws Exist
For two-years of engagement, Anna Bankes and Justin Neis decided to get married on July 13, 2013 at the Mandan United Methodist Church. Unfortunately, even with bridesmaids and groomsmen, the pastor refuses to marry the couple.
Both of them have disabilities - Anna Bankes has intellectual disabilities and still in development stage like a 15 year while Justin Neis has a physically disabilities forcing him to use a wheelchair.
"He is 33 and she is 42. They both understand what they are getting into," said by Bankes' sister Charlene Bolton.
Justin Neis is a Catholic and wanted get married in his church, the Spirit of Life in Mandan. Rev. Chris Kadrmas is a pastor in that church and the one who told them - they are not prepared to be married at this time.
No legal impediments are troubling their marriage and assured that nothing in the future will. But the pastor refuses to have the couple married due to church doctrine issue.
"But he would not budge, citing church doctrine," said by Bolton.
Bishop David Kagan of the Diocese of Bismarck and Rev. Kadrmas agreed on concern of what is best for the long term effect on couple. The bishop did not also disclose the details due to issues of confidentiality.
'In cases where one or more of the parties has a guardian, the church mandates that priests consider whether the party or parties truly have unfettered freedom to freely choose to consent to the marriage,' according to Bishop Kagan.
Neis and Bankes are not impossible to reach marriage but Kadrmas suggests taking more time to make sure they are truly prepared. He also suggested Neis should move to a group home for six months to a year from his separate apartment in his parents' house.
The challenged couple still plans to continue to marriage but at a different church this summer.
