Reese Witherspoon Arrested For Disorderly Conduct After Husband’s DUI Arrest
Reese Witherspoon apparently thought her celebrity status would get her husband out of trouble. The "Legally Blonde" star was so pissed that husband Jim Toth was being arrested for DUI that she told the arresting officer, "You're about to find out who I am."
The couple was in Atlanta, Georgia early Friday morning when a cop pulled over their silver Ford Fusion after noticing that it was weaving into the opposite traffic lane. They also noted that Toth, who was driving the car, appeared dishevelled and that his breath smelled of alcohol, prompting the cop to administer a sobriety test.
According to the police report, as the officer asked Toth to pull out and step out from the vehicle, Witherspoon became increasingly agitated from the vehicle. She then expressed her doubt about the officer.
"Mrs. Witherspoon began to hang out the window and say that she did not believe that I was a real police officer," the police report, obtained by Variety, read. "I told Mrs. Witherspoon to sit n her butt and be quiet."
But she did not heed the advice and exited their car once her husband was placed under arrest. She also "stated that she was a U.S. citizen" and that she was allowed to "stand on American ground."
The officer reported how she resisted as he grabbed her arms while Toth attempted to calm her down.
"Mrs. Witherspoon asked, 'Do you know my name?' I answered, 'No, I don't need to know your name,'" according to the police report. "Mrs. Witherspoon stated, 'You're about to find out who I am.'"
The report continued, "Mrs. Witherspoon also stated, 'You are going to be on national news.' I advised Mrs. Witherspoon that was fine."
She was then arrested for disorderly conduct after disobeying repeated instructions from the officer. Toth registered a .139 on the Breathhalyzer test, and was charged with a driving under the influence. He is also facing a second charge for failure to maintain a lane while driving.
The 37-year-old actress and her 42-year-old husband, who works in the talent agency which represents Witherspoon, were released on bond at 3:30am. They are scheduled to appear in court on Monday morning, though sources told Variety that they aren't expected to appear, and that their attorney will be requesting the court to postpone the date.
Witherspoon and Toth married in 2011. They have one son together, Tennessee James Toth, who was born in September last year. She also has two children from her previous marriage to fellow actor Ryan Phillippe.
