Lindsay Lohan has turned down the guilty plea offered by an LA court judge that could have ended the actress’s legal battle over the felony grand theft filed against her by the District Attorney’s office over a stolen necklace.

According to the Associated Press, Lohan’s rejection of the plea offer means that the 24-year old 'Mean Girls' star is set on fighting the court to prove her innocence on the accusations that she walked out of the Kamofie & Co. jewelry shop in Venice California without handing in $2,500 payment for the necklace.

Citing the statement by the spokeswoman of the District Attorney’s office, Jane Robison, the AP said that it was Lohan’s attorney, Shawn Chapman Holley who notified the prosecutor and the court that Lohan is rejecting the judge’s plea offer.

Lohan’s camp has been in the dark on the details of the plea offer by Los Angeles Superior Court Judge Keith Schwartz.

But one thing is clear about the offer that the the judge has repeatedly emphasized to Lohan and her legal team since the actress's first appearance over the stolen necklace on February 9 - - that the actress will be sentenced to jail should she pleaded no contest or guilty on the felony grand theft over the stolen necklace.

AP added that the LA state prosecutors are also bent on getting Lohan jailed after the actress had reportedly violated probation for the 2007 arrest under the influence. As earlier explained in a separate report by IBTimes, the actress is likely to get jailed because she violated her 2007 probation when she was implicated in the stolen necklace in Venice jewelry store.

With Lohan’s decision, the actress is now required to appear in court on April 22 for the preliminary hearing. The IBTimes filed in an earlier report that Lohan will be tried by new judge should she opt to fight the theft case hurled against her. Click here for the full report.

AP said, Lohan has pleaded not guilty to the felony grand theft charge and has strongly denied any wrong doing.

The ball now is in the court of the prosecution to prove Lohan’s misdeeds as she left the Kamofie & Co store smiling, with the necklace she wore with the help of the store assistant.

The state prosecutors pursued the case over the stolen jewelry using two major evidences against the actress: a picture of the actress wearing the necklace that have surfaced on the web and the surveillance video from the jewelry store showing the actress leaving the store with the necklace.
