On Monday, Joel Parker Henderson, the alleged murderer of 14-year-old Timothy “Timmy” O’Brien would continue to face trial, the Victorian Supreme Court declared. In January 2013, Mr. Henderson killed Timothy along with a few others.

The boy was severely beaten on his head when he tried to help his step dad, Peter Williams, from getting assaulted by Mr. Henderson and others, who were reportedly sent by Mr Williams’ cousin, Darren Wilson to avenge a dispute. Forensic reports showed that Timothy had eight major injuries to the right side of his head along with several others and had already passed away before the arrival of police.

The incident took place at a Scardale home, near Ballarat. It was reported that Timothy tried to fend off the attackers with a baseball bat when they were attacking his stepdad. As the situation intensified with anger form both sides, Henderson got hold off Timothy and started bashing his head while pinning him to the ground. He used the axe, which he had carried to assault Mr. William. One of the onlookers, as Herald Sun reported, pleaded Henderson to leave the little boy out, however, his only response was “Die, c***, die.”

Crown prosecutor Christopher Dane, QC, told the Victorian Supreme Court on Monday that Mr. Henderson was bribed to lure Mr. Williams and assault him. Timothy couldn’t control himself when he saw his stepdad being repeatedly punched by Mr. Wilson, so Tim started hitting him with his bat and “as events transpired that loyalty cost Timmy O’Brien his life,” he said. Mr. Dane alleged that it was a 'collective' attempt by Henderson and Wilson. However, defence barrister said that there was no such agreement.

According to the documents of the court, Mr. Henderson has not for once pleaded guilty to any counts over Timothy’s murder. Hence, the Victorian Supreme Court declared to continue the trial, reported Skynews.
