A UK judge who heard Apple's appeal for its intellectual property case against Samsung ruled that the Korean device maker did not copy the iPad design.

Samsung emphasized that buyers could easily tell the difference between the iPad and Galaxy Tab without having to examine the devices closely. The court paid attention to "front surface design and in the thinness of the side profile" and "found the most vivid differences in the rear surface design."

"Apple's excessive legal claims based on such a generic design right can harm not only the industry's innovation as a whole, but also unduly limit consumer choice."

In the original ruling issued in July, the judge ruled Samsung did not copy Apple's design because the Galaxy Tab is "not as cool" as the iPad. The court upheld its decision after Apple lodged an appeal. And now Apple has to apologize to Samsung via UK media.
