California Judge Upholds LA Voter-Approved Law Requiring Porn Actors to Wear Condom While Filming (VIDEOS)

No barebacking. A California federal judge upheld on Friday a voter-approved rule in Los Angeles Country that mandates the wearing of a condom by porn actors when filming sex scenes.

In issuing the decision, Judge Dean Pregerson rejected the request for a preliminary injunction to put on hold the measure while producers of X-rated movies legally challenge the rule. The porn makers claim that Measure B breached their free speech right.

However, Mr Pregerson thumbed down their request because he believes the porn producers would lose their lawsuit.

The lawsuit was filed by two porn producers and two porn actors against the Los Angeles County Safer Sex in the Adult Film Industry Act. Besides allegedly violating their free speech rights under the First Amendment, the producers and actors warned enforcing the measure would negatively impact California's economy since porn makers would just shoot their movies in other states where the condom is not required for shooting sex scenes.

They also argued porn actors anyway are regularly tested for sexually transmitted diseases, by the judge did not buy their argument.
