Samsung Electronics Co. agreed Monday to postpone the launch of its Galaxy Tab 10.1 in Australia until the last week of September while its battle with Apple is fought out in court.

The delay was agreed at an interlocutory hearing in the Federal Court before Justice Annabelle Bennett in Sydney.

"Following today's hearing in the Federal Court of Australia, Samsung has agreed to delay the launch of the Galaxy Tab 10.1 pending the court's decision in the week commencing September 26, 2011," Samsung said in a statement this afternoon.

"It should be noted that the court has not issued an injunction against the sale of the Galaxy Tab 10.1, and the court did not make any ruling during today's hearing," the company stressed.

The electronics company had previously planned on launching the disputed Galaxy Tab earlier this month and then delayed it because of the legal dispute with Apple. The two tech companies have been embroiled in a legal war with suits filed around the globe including South Korea, Germany and Japan. Apple initially filed a patent complaint against Samsung in the U.S. court claiming Samsung copied Apple's iPad and iPhone designs.

Samsung said that it will file a cross claim against Apple Australia and Apple Inc. in the Federal Court of Australia.

"Today, Samsung Electronics informed the Federal Court of Australia it intends to file a cross claim against Apple Australia and Apple Inc. regarding the invalidity of the patents previously asserted by Apple and also a cross claim against Apple regarding violation of patents held by Samsung by selling its iPhones and iPads," the company said in a statement.

Samsung promised its consumers that it would continue to defend its right to release the Tab in Australia.

"Samsung will continue to pursue all possible measures including legal action to defend its intellectual property rights and ensure its innovative products remain available to consumers throughout the world."

Bennett has set the hearing for the last week of September where there would either be a judgment or a new agreement about the Tab distribution in Australia.
