"Desperate Housewives" former cast member Nicollette Sheridan bursts in tears during the opening remarks of her attorney when they attended the court for the lawsuit she filed against the show's creator Marc Cherry.

Sheridan is suing Cherry for wrongful termination and battery. She claims that the creator slapped her face during a disagreement on the script which was later on followed by her termination from the show.

In defense to Cherry, his attorney Adam Levin stated that Sheridan's character has run its course and it was time for the character to exit.

"There were only so many husbands she could sleep with," Levin said pertaining to Sheridan's character in the show.

Meanwhile, Sheridan's attorney said that his client is taking it alone in a town where nobody would stand up against a television network. Mark Baute, her attorney, also argued that the episode where Sheridan's character dismissed was "poorly written."

"Bottom line, this was retaliatory termination by someone who knew what he wanted to do, when he wanted to do it," Baute said.

"Housewives" stars including Teri Hatcher, Eva Longoria, Felicity Huffman and Marcia Cross are among those who are due to speak in behalf of Cherry to discredit Sheridan's claims.

Cherry's attorneys are countering that being the show's creator he has the right from the First Amendment to do whatever he wants with the character he created for the show. The trial is expected to last up to 11 days.
