[UPDATE: New rumours about the PS4, plus the effects of Xbox One's indie policy.]

With Microsoft's new policy on independent game publishing for the Xbox One finally rolled out in the form of the ID@Xbox, it seems that there may be problems for some publishers who have already had deals with releasing for the PS4 as well as other consoles.

In a report from Australian developer Witch Beam, who was locked out of the Xbox One indie developer program, it seems that there is a day one parity clause that requires developers to delay their games on other platforms if they wanted to publish on Xbox One.

IGN reports that, while Microsoft does deal with developers on a case-to-case basis, depending on the need of the independent publisher, those who are the likes of Witch Beam, who didn't have any exclusivity deals, cannot obtain a waiver to land into the ID@Xbox for one of their multiplatform games.

In the PS4 Reddit, gamers are giving their own reactions to Microsoft's new indie policy for indie developers. Even proclaimed fans of the Xbox have stated their displeasure at Microsoft's handling that indie gaming development.

"Xbox has been falling dramatically short on exclusives in recent years and this wil just widen that disparity," said stansteamer. "I've simply always preferred Xbox over PlayStation for the first two Xbox generations. Microsoft's behavior lately is mind-boggling."

"It's actions like this that make people dislike Microsoft. Instead of coming up with an incentive, or some other creative way to attract Indies and benefit their customers, they punish developers for not abiding by their rules. They're not creating a friendly business environment, or seemingly even trying to with clauses like that," said GJBM.

Sony Move for the next generation?

A patent has been spotted for a possible new controller for Sony's PS4, and Push Square suggests that this may be a type of PlayStation Move meant for the PS4.

According to the report, in the same vein that the DualShock 4 retains most of the DualShock 3's main design and components, this new motion device seems to retain most of the functions of the PlayStation Move from PS3. The addition lies in the touchpad.

This new touchpad would serve as the thumb support on the motion device, so the gamer can easily move without inconveniencing the user's thumb. The slight friction that the thumb has on the touchpad is already recognised by the device. Sony has also been rumoured about making its own PlayStation Move to add a variety to the way that the PS4 can be played, though no official announcement has been released yet.

Sony winning in expert's views and in one region?

There have been mixed reports regarding the performance of the two next-gen consoles, PS4 and Xbox One. While one seems to be breaking records in areas like Australia, the other has unprecedented demand, so much so that the company does have problems trying to keep up with the supply.

However, one expert, Michael Pachter or Wedbush Securities, has been very vocal about what he thinks of the console war and who he thinks emerges as the winner: none other than PS4.

In a report from Gamerant, Pachter had noted several aspects in the current gaming trend, from how Nintendo's sales is dismal at best to how the shift to buying next-gen consoles may be hurting games like Battlefield 4 and Call of Duty: Ghosts. And in addition to those, Pachter has also predicted Sony as the winner in the console wars, mostly because of the estimated 1.25 million PS4 units sold in November compared to the Xbox One's 750,000 in the U.S. alone.

But perhaps to substantiate the fact that the PS4 does have a good standing in terms of sales, PlayStation CEO James Armstrong has been reported saying that the PS4 is outselling the Xbox One 3 units to 1 in Spain, according to CVG.

As far as the figures are concerned, 80,000 PS4 units have been moved, with expectations of around 12,000 to 15,000 preorders still in the pipeline. No figures have been provided on the side of Xbox One though.
